Terms of Service

These Terms of Service ("Terms") form a legal agreement between you and Phatlinks.com LLC ("Casper's Cloak", "we", "us", "our") and govern your use of the Casper's Cloak iOS app, Android app, and website at casperscloak.com (together, the "Service").
Please read them carefully. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Casper's Cloak is a consumer privacy product. It provides:
- A VPN tunnel built on the WireGuard protocol that routes your internet traffic through servers we operate.
- DNS-level threat blocking against a curated blocklist of domains associated with malware, phishing, advertising, and tracking.
- Cover-traffic generation intended to reduce the effectiveness of traffic-analysis techniques.
- Account, subscription, and notification features.
We may add, remove, or modify features at our discretion. We will give you reasonable notice of material changes that reduce functionality you have already paid for.
2. Eligibility
You may use the Service only if:
- You are at least 13 years old (or 16 years old if you are in the European Economic Area or United Kingdom).
- You have the legal capacity to enter into a binding contract in your jurisdiction.
- You are not barred from using the Service under applicable law (for example, you are not on a US sanctions list, and you are not located in a jurisdiction where the Service is prohibited).
If you use the Service on behalf of a business, you represent that you have authority to bind that business, and "you" includes both you individually and the business.
3. Your account
To use most of the Service you must create an account. You agree to:
- Provide accurate information.
- Keep your access to your registered email address secure (we send one-time login codes to it).
- Be responsible for all activity that occurs under your account.
- Notify us promptly at support@casperscloak.com if you suspect unauthorized use of your account.
You may delete your account at any time. See our Privacy Policy, Section 9, for the steps. Account deletion ends your right to use the Service.
4. Acceptable use
You agree not to use the Service to:
- Break the law. This includes copyright infringement, trafficking in stolen data, unauthorized access to computer systems, child sexual abuse material, sanctions evasion, fraud, and any other criminal activity.
- Attack other systems. No port scanning, denial-of-service attacks, network intrusion attempts, vulnerability exploitation, or unauthorized penetration testing through our network.
- Send unsolicited commercial messages or commit any kind of spam, fraud, phishing, or social-engineering attack.
- Distribute malware or content designed to harm computer systems or users.
- Resell or redistribute the Service without a written agreement with us.
- Interfere with the Service itself: no probing, reverse-engineering for the purpose of circumventing access controls, scraping at a rate that affects availability, or attempting to overwhelm our infrastructure.
- Misrepresent yourself or impersonate another person or organization.
- Use the Service to harass or threaten other people.
We may suspend or terminate your account if we determine you have violated this section, with or without notice. We may also report illegal activity to the appropriate authorities.
The fact that traffic through Casper's Cloak is encrypted to our servers does not mean it is invisible to law enforcement: we comply with valid legal process. See our Privacy Policy for details on what we do and do not log.
5. Subscriptions and billing
Some features of the Service require a paid subscription. The pricing and feature breakdown are described at casperscloak.com.
5.1 How you pay
Depending on where you subscribe, your payment is processed by:
- Apple (in-app purchases on iOS) — governed by Apple's standard subscription terms.
- Google (Google Play Billing on Android) — governed by Google's standard subscription terms.
- Stripe (when you subscribe via casperscloak.com) — Stripe processes your card data directly under its own terms; we receive only a customer reference and tier confirmation.
5.2 Auto-renewal
Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date.
- Apple subscriptions: manage and cancel in iOS Settings → [your name] → Subscriptions, or at apps.apple.com/account/subscriptions. Apple's terms control timing of cancellation.
- Google subscriptions: manage and cancel in the Google Play Store → Subscriptions, or at play.google.com/store/account/subscriptions. Google's terms control timing.
- Stripe / web subscriptions: sign in to casperscloak.com → Account → Billing to cancel.
You will retain access to paid features for the remainder of the billing period you have already paid for.
5.3 Free trials
If we offer a free trial, you must cancel before the trial ends to avoid being charged. We will display the price, billing cadence, and trial end-date clearly before you sign up.
5.4 Refunds
- For purchases made through Apple, refunds are governed by Apple's policies. Request refunds via reportaproblem.apple.com. We cannot directly refund an Apple-managed transaction.
- For purchases made through Google, refunds are governed by Google Play's policies. Request refunds via the Google Play Store. We cannot directly refund a Play-managed transaction.
- For purchases made through Stripe / casperscloak.com, you may request a refund within 14 days of your initial purchase by emailing support@casperscloak.com. After the 14-day window, refunds are at our discretion.
Statutory refund and withdrawal rights (including the EU 14-day right of withdrawal for digital services, where applicable) are not affected by this section. By purchasing a subscription that begins immediately, you may be agreeing to begin performance during the withdrawal period; where local law allows, this can reduce the refund amount you are entitled to.
5.5 Price changes
We may change subscription prices. Existing subscribers will be notified at least 30 days before a price change takes effect for their renewal. Continued use of the Service after the change takes effect constitutes acceptance of the new price.
5.6 Taxes
Prices shown do not include applicable sales tax, VAT, or other taxes unless explicitly stated. You are responsible for any taxes due under the law of your jurisdiction.
6. License
We grant you a personal, non-exclusive, non-transferable, revocable, limited license to use the Service for your personal, non-commercial use, subject to these Terms. You may not:
- Copy, modify, or create derivative works of the Service;
- Reverse-engineer the Service except to the extent applicable law prohibits restricting such reverse-engineering;
- Remove or alter copyright, trademark, or proprietary notices;
- Use the Service to build a competing product.
The Service includes open-source components (notably WireGuard®, which is a registered trademark of Jason A. Donenfeld). Those components are licensed to you under their respective open-source licenses, which we make available on request.
7. Apple-specific terms (iOS only)
This Section 7 applies if you use the Casper's Cloak iOS app, in addition to the rest of these Terms. In the event of a conflict between this Section 7 and the rest of these Terms, this Section 7 governs for use of the iOS app.
- These Terms are between you and Phatlinks.com LLC only, not Apple. Apple is not responsible for the iOS app or its content.
- Apple has no obligation to provide maintenance or support for the iOS app.
- If the iOS app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation.
- We, not Apple, are responsible for product liability claims, claims that the iOS app fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar laws.
- We, not Apple, are responsible for addressing third-party intellectual-property infringement claims relating to the iOS app.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and you are not on any US Government list of prohibited or restricted parties.
8. Google Play / Android terms
This Section 8 applies if you use the Android app. In addition to these Terms, your use of the Android app is also subject to the Google Play Terms of Service (play.google.com/intl/en_us/about/play-terms/). To the extent of any conflict regarding distribution and licensing, the Google Play Terms control for those matters; otherwise these Terms control.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE;
- ANY VPN CONNECTION WILL ALWAYS BE AVAILABLE OR FAST;
- THREAT BLOCKING WILL DETECT EVERY MALICIOUS DOMAIN;
- COVER-TRAFFIC GENERATION WILL DEFEAT EVERY FORM OF TRAFFIC ANALYSIS;
- THE SERVICE WILL MAKE YOU FULLY ANONYMOUS ON THE INTERNET — IT WILL NOT.
YOU ARE RESPONSIBLE FOR YOUR OWN CONDUCT ONLINE. NO PRIVACY TOOL, INCLUDING OURS, IS A SUBSTITUTE FOR GOOD JUDGMENT.
Some jurisdictions do not allow the exclusion of certain warranties. To the extent your jurisdiction does not allow such exclusion, the warranties above apply only to the extent permitted by law, and you may have additional rights.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST DATA, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD 50.
Some jurisdictions do not allow the limitation of liability for incidental or consequential damages. To the extent your jurisdiction does not allow such limitations, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Phatlinks.com LLC and its officers, directors, employees, and agents from and against any third-party claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- your violation of these Terms;
- your violation of any law or third-party right;
- your use of the Service in violation of Section 4.
12. Termination
You may terminate these Terms at any time by deleting your account.
We may suspend or terminate your account, with or without notice, if:
- You violate these Terms (especially Section 4 — Acceptable use);
- We are required to do so by law;
- The Service is being abused in a way that threatens its integrity or other users.
Sections that by their nature should survive termination (including Sections 9, 10, 11, 13, 14, and 15) survive termination of these Terms.
13. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If you are a consumer based outside the United States, mandatory consumer-protection laws of your country of residence may grant you additional rights that this section does not displace.
14. Dispute resolution
14.1 Informal resolution first
Before filing any claim, you agree to first contact us at support@casperscloak.com and try in good faith to resolve the dispute for at least 30 days.
14.2 Arbitration (US users)
If we cannot resolve the dispute informally, and to the extent permitted by law, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Sarasota, Florida or, at your election, by telephone or video, or in your county of residence.
You and we both waive the right to a jury trial and the right to participate in a class action.
You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@casperscloak.com with the subject line "Arbitration opt-out" and including your name and account email.
14.3 Small-claims court
Either party may bring a qualifying claim in small-claims court instead of arbitration.
14.4 EEA / UK / Switzerland users
If you are a consumer in the EEA, UK, or Switzerland, the arbitration provisions in 14.2 do not apply. You can bring a claim in the courts of your country of residence, or, at your option, in the courts of Florida, USA.
15. Changes to these Terms
We may update these Terms. When we do:
- We will post the updated Terms at casperscloak.com/terms-of-service.
- We will update the "Last updated" date at the top.
- For material changes, we will give you at least 30 days' notice by email or in-app message.
If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.
16. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements.
- Severability. If any provision of these Terms is held to be unenforceable, the rest will remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of that provision.
- No assignment. You may not assign your rights under these Terms without our written consent. We may assign our rights to an affiliate or in connection with a sale of all or substantially all of our business.
- Notices. We will give you notices by email to the address on your account or by in-app message. You can give us notice at the address in Section 17.
